Open letter – Marijana Mugoša’s case

OPEN LETTER

Dear sir/madam

After the verdict of the High Court in the case of our member  Marijana Mugosa became final, and after expiration of deadline for voluntary execution, and reliance on the notice of city officials that they will act according to court decision, this morning Marijana with her attorney, Ms. Knezevic, again tried to get her job in Njegoseva 13. Unfortunately, as in the past 19 months, Marijana could not get further from the reception. Humiliation for her and the entire legal system of our country is even worst, it was not allowed to her to enter even in the lobby of the building, to sit down and wait an explanation of her superiors. This has been confirmation that in the building of Capital city access for persons with disabilities who use assistance dogs, is still forbidden, which is particularly noted for their employees, such as in the case of Marijana.

Then, the attorney Ms. Knezevic asked recepton from Mrs. Maras, to explane her  further steps in relation to compulsory execution of judgments, which today we intend to take and apply to the President of the High Court. Mrs. Maras, Chief Secretary of the City, said that for her final court decision is not binding, and that explanation of the verdict does not mean anything, because they provided an office for Marijana, away from other employees and away from the office where she was working for six years. Also, Mrs. Maras suggested (sounds very cynical) to Marijana and her attorney that they can file a ‘request for protection of constitutionality’ or even can go to the Strasbourg Court, all as if the verdict is not completely in Marijana’s benefit and like she is affected party.

Such disregard of clear court decisions and not acting on them, calls into question basic security of all citizens and respection of their rights. Also, we believe that this is astray, and not the way for entry into the European Union.
At the end we want to stress,that this will be a very important exam, where they will show real strength and maturity of our country, and our optimism and perseverance will not run out until the final fullfilment of justice.
